Transport and shipment of hazardous materials and dangerous goods<\/h2>\n\n\n\n<p>University personnel are responsible for complying with applicable federal and state laws and regulations when engaging in the following activities or preparing materials related to the transport and shipment of hazardous materials or dangerous goods:<\/p>\n\n\n\n<ul>\n<li>Packaging<\/li>\n\n\n\n<li>Marking<\/li>\n\n\n\n<li>Labeling<\/li>\n\n\n\n<li>Preparing documentation<\/li>\n\n\n\n<li>Loading<\/li>\n\n\n\n<li>Offering materials for shipment<\/li>\n<\/ul>\n\n\n\n<p>Likewise, University personnel who engage in the above activities must be properly trained in accordance with this policy.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Applicability<\/h3>\n\n\n\n<p>This policy applies to University personnel and students at all WSU locations, including, but not limited to, regional campuses, research stations, extension offices, nursing locations, other WSU-affiliated offices, and non-WSU offices.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Responsible offices<\/h3>\n\n\n\n<p>Those having questions regarding this policy are to contact the applicable office below.<\/p>\n\n\n\n<ul>\n<li><strong>Hazardous materials shipping<br><\/strong><a href=\"https:\/\/research.wsu.edu\/assurances\/contact\/\">Office of Research Assurances<\/a> (ORA)<\/li>\n\n\n\n<li><strong>Chemical hazards<br><\/strong><a href=\"https:\/\/ehs.wsu.edu\/contact-information\/\">Environmental Health and Safety<\/a><br><a href=\"https:\/\/research.wsu.edu\/assurances\/instructions-for-shipping\/\">Contacts by campus\/location <\/a><\/li>\n\n\n\n<li><strong>Biological hazards<br><\/strong><a href=\"https:\/\/biosafety.wsu.edu\/contact\/\">Biological safety officer<\/a> (IBC)<\/li>\n\n\n\n<li><strong>Radiation hazards<br><\/strong><a href=\"https:\/\/rso.wsu.edu\/contacts\/\">Radiation Safety Program<\/a> (RSC)<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Definition: Hazardous material\/dangerous good<\/h3>\n\n\n\n<p>A dangerous good is defined as a substance or material that has been determined by the Secretary of Transportation to be capable of posing an unreasonable risk to health, safety and property when transported in commerce. Materials that are hazardous to the environment (i.e., hazardous substance, hazardous wastes, and marine pollutants) are also regulated.<\/p>\n\n\n\n<p>For purposes of this policy, hazardous materials and dangerous goods are used interchangeably within this document. Hazardous materials include, but are not limited to:<\/p>\n\n\n\n<ul>\n<li>Laboratory, maintenance, and agricultural chemicals<\/li>\n\n\n\n<li>Biological agents<\/li>\n\n\n\n<li>Radioactive materials<\/li>\n\n\n\n<li>Compressed gases<\/li>\n\n\n\n<li>Patient specimens<\/li>\n\n\n\n<li>Dry ice<\/li>\n\n\n\n<li>Refrigerants and related equipment<\/li>\n\n\n\n<li>Lithium batteries<\/li>\n\n\n\n<li>Samples taken directly from an animal or human<\/li>\n\n\n\n<li>Samples to be tested for a pathogen, virus, or bacteria<\/li>\n\n\n\n<li>Instruments\/equipment that contain hazardous materials<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Department of Transportation (DOT)<\/h4>\n\n\n\n<p>Refer to DOT regulations for domestic transport of hazardous materials by rail, air, vessels, and motor carrier at <a href=\"https:\/\/www.ecfr.gov\/cgi-bin\/text-idx?SID=028795e5b4a0b194cc473338c7237c13&amp;mc=true&amp;tpl=\/ecfrbrowse\/Title49\/49CIsubchapC.tpl\">49 <em>CFR <\/em>171-185<\/a>.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">International Air Transport Association (IATA)<\/h4>\n\n\n\n<p>IATA has established <a href=\"https:\/\/www.iata.org\/publications\/dgr\/Pages\/index.aspx\">guidelines for the transport of dangerous goods by air<\/a>.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Department of Homeland Security Chemicals of Interest (COI)<\/h4>\n\n\n\n<p>University faculty, staff and students may not ship any chemical on the Department of Homeland Security&#8217;s <a href=\"https:\/\/www.dhs.gov\/cisa\/appendix-chemicals-interest\">Chemicals of Interest (COI) list<\/a>. If assistance is needed, contact EH&amp;S to determine available options.<\/p>\n\n\n\n<div style=\"height:100px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading  wsu-heading--style-marked wsu-heading--mark-top\" id=\"shipping-requirements\">2. Shipping requirements<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Trained coordinators<\/h3>\n\n\n\n<p>Any Washington State University student, staff, or faculty member who intends to offer dangerous goods for transportation or shipment must either be a trained University hazardous materials shipping coordinator or must contact a trained University hazardous materials shipping coordinator for assistance.<\/p>\n\n\n\n<p>The training must be in conformance with <a href=\"https:\/\/www.ecfr.gov\/cgi-bin\/text-idx?SID=3741f73025b9c62846ae14a3d5265342&amp;mc=true&amp;node=pt49.2.172&amp;rgn=div5#sp49.2.172.h\">49 <em>CFR <\/em>172 Subpart H <\/a>and include IATA training. See training requirements.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Coordinator database<\/h4>\n\n\n\n<p>The Office of Research Assurances maintains a database of trained shipping coordinators. <a href=\"https:\/\/research.wsu.edu\/assurances\/contact\/\">Telephone the office<\/a> to obtain contact information for trained shipping coordinators.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Coordinators for WSU locations<\/h4>\n\n\n\n<p>Each WSU location that offers dangerous goods for shipment is required to ensure that:<\/p>\n\n\n\n<ul>\n<li>At least one employee is trained as a hazardous materials shipping coordinator, <em>or <\/em><\/li>\n\n\n\n<li>The person preparing the shipment seeks the assistance of a trained hazardous materials shipping coordinator when preparing shipments of dangerous goods. (To obtain assistance, contact the <a href=\"https:\/\/research.wsu.edu\/assurances\/contact\/\">Office of Research Assurances<\/a>.)<\/li>\n<\/ul>\n\n\n\n<p>The trained hazardous materials shipping coordinator is responsible for ensuring that all packages offered for shipment are prepared according to the applicable shipping regulations.<\/p>\n\n\n\n<div style=\"height:100px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading  wsu-heading--style-marked wsu-heading--mark-top\" id=\"emergency-response-information\">3. Emergency response information<\/h2>\n\n\n\n<p>An emergency response telephone number must be provided on shipping papers associated with certain hazardous materials. The telephone number must be monitored 24 hours a day while the hazardous material is in transportation, including storage incidental to transportation. This telephone number must be the number of either:<\/p>\n\n\n\n<ul>\n<li>The person offering the hazardous material for transportation (if trained as a hazardous materials shipping coordinator); <em>or <\/em><\/li>\n\n\n\n<li>The number of an agency or organization capable of, and accepting responsibility for, providing detailed information concerning the hazardous material.<\/li>\n<\/ul>\n\n\n\n<p>To provide this emergency response contact, WSU maintains a service contract with a third-party vendor that assists emergency responders in dealing with incidents involving hazardous materials in transit.<\/p>\n\n\n\n<p>It is the responsibility of the person packaging the materials for shipping to ensure that certain packages containing hazardous materials lists the proper emergency response telephone contact number.<\/p>\n\n\n\n<p>Contact the <a href=\"https:\/\/research.wsu.edu\/assurances\/contact\/\">Office of Research Assurances<\/a> for more information or to obtain the third-party emergency response vendor&#8217;s telephone number.<\/p>\n\n\n\n<div style=\"height:100px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading  wsu-heading--style-marked wsu-heading--mark-top\" id=\"exceptions\">4. Exceptions<\/h2>\n\n\n\n<p>Shipments prepared under the following circumstances are not subject to requirements of this section, other than as noted.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Internal WSU transport<\/h3>\n\n\n\n<p>The transport of hazardous materials by University personnel, either in person or when using University or private vehicles, solely for non-commercial University purposes is exempt from DOT regulations but must comply with this policy.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Requirements<\/h3>\n\n\n\n<p>Transport of hazardous materials by University personnel may be conducted only when the following conditions or requirements are fulfilled.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Containers<\/h4>\n\n\n\n<ul>\n<li>The material must be in appropriate, leak-proof containers or packaging.<\/li>\n\n\n\n<li>Secondary containment is to be used to contain any spill of the hazardous materials being transported.<\/li>\n\n\n\n<li>Incompatible materials are to be separated into different secondary containers.<\/li>\n\n\n\n<li>When in a vehicle, hazardous materials are to be transported in the trunk, or as far away from passengers as possible.<\/li>\n\n\n\n<li>All containers are to be clearly labeled with content information and precautionary instructions (e.g. warning labels for pesticides, controlled substances, etc.). Individuals must have access to Safety Data Sheets.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Materials and supplies<\/h4>\n\n\n\n<p>Materials and supplies, including personal protective equipment needed to contain or clean up a spill are to be available in the vehicle.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Individuals<\/h4>\n\n\n\n<p>Individuals transporting hazardous materials must either:<\/p>\n\n\n\n<ul>\n<li>carry a method of communication should a spill or release occur,<\/li>\n\n\n\n<li>be accompanied by another individual, or<\/li>\n\n\n\n<li>be in an area where campus EH&amp;S personnel can respond in a timely manner.<\/li>\n<\/ul>\n\n\n\n<p>See sections on training, vacating areas or employment, and regulations and approvals below for additional requirements applicable to individuals transporting hazardous materials.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Training<\/h4>\n\n\n\n<p>The individual transporting hazardous materials must be trained and familiar with each material&#8217;s hazards, the precautionary measures to avoid those hazards, and procedures to contain or clean up a spill or contact appropriate personnel.<\/p>\n\n\n\n<p>It is strongly recommended that individuals new to transporting hazardous materials, or transporting new or different materials consult with Environmental Health &amp; Safety staff to ensure they have appropriate knowledge, training, and materials to safely transport hazardous materials.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Vacating areas or employment<\/h4>\n\n\n\n<p>Individuals vacating University areas or moving from one campus to another must follow the procedures in <em>Business Policies and Procedures Manual <\/em>(<em>BPPM<\/em>) <a href=\"https:\/\/policies.wsu.edu\/prf\/index\/manuals\/60-00-personnel\/60-38-notice-faculty-staff-departure-vacating-university-areas\/\">60.38<\/a> and <a href=\"https:\/\/policies.wsu.edu\/prf\/index\/manuals\/60-00-personnel\/60-74-employee-departure-procedures\/\">60.74<\/a>.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Regulations and approvals<\/h4>\n\n\n\n<p>Individuals transporting hazardous materials from one campus to another or from a research site must follow the regulation listed above (see Department of Transportation (DOT)) and be approved by:<\/p>\n\n\n\n<ul>\n<li>EH&amp;S for the transporting of chemicals,<\/li>\n\n\n\n<li>ORA for the transportation of biological materials, and\/or<\/li>\n\n\n\n<li>RSO for the transporting of radioactive materials.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Radioactive materials<\/h4>\n\n\n\n<p>All outgoing University shipments of radioactive materials or radiation machines must be coordinated through the <a href=\"https:\/\/rso.wsu.edu\/\">Radiation Safety Program<\/a>. This requirement applies to all University locations. RSO handles all aspects of such shipments, including coordination with the transporter.<\/p>\n\n\n\n<div style=\"height:100px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading  wsu-heading--style-marked wsu-heading--mark-top\" id=\"shipment-of-wastes\">5. Shipment of wastes<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Hazardous chemical wastes<\/h3>\n\n\n\n<p>This section does not apply to hazardous chemical wastes. See <a href=\"https:\/\/policies.wsu.edu\/prf\/index\/manuals\/5-00-contents\/5-66-recycling-disposal-chemical-wastes\/\"><em>SPPM <\/em>5.66<\/a> and <a href=\"https:\/\/policies.wsu.edu\/prf\/index\/manuals\/5-00-contents\/5-68-accumulation-dangerous-chemical-waste\/\">5.68<\/a> for procedures for managing hazardous chemical wastes. NOTE: The campus Environmental Health &amp; Safety office coordinates and contracts for the transportation of chemical wastes.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Radioactive wastes<\/h3>\n\n\n\n<p>This section does not apply to radioactive wastes. See <a href=\"https:\/\/policies.wsu.edu\/prf\/index\/manuals\/9-00-radiation-safety\/9-70-radioactive-waste-management\/\"><em>SPPM <\/em>9.70<\/a> for procedures for managing radioactive wastes. For current guidelines refer to the <a href=\"https:\/\/rso.wsu.edu\/\">Radiation Safety Program<\/a>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Biohazard wastes<\/h3>\n\n\n\n<p>This section does not apply to biohazard waste offered for shipment in commerce. See <a href=\"https:\/\/policies.wsu.edu\/prf\/index\/manuals\/4-00-contents\/4-24-disposal-biohazard-wastes\/\"><em>SPPM <\/em>4.24<\/a> for procedures for managing biohazard wastes. For further information, refer to the <a href=\"https:\/\/biosafety.wsu.edu\/biohazardous-waste\/\">biosafety website<\/a>.<\/p>\n\n\n\n<div style=\"height:100px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading  wsu-heading--style-marked wsu-heading--mark-top\" id=\"training\">6. Training<\/h2>\n\n\n\n<p>It is the responsibility of the supervisor to ensure that the hazardous materials shipping coordinator has received adequate training related to their job functions. In accordance with <a href=\"https:\/\/www.ecfr.gov\/cgi-bin\/text-idx?SID=7b014d8e92c0c765d47008965bb18e2b&amp;node=sp49.2.172.h&amp;rgn=div6\">49 <em>CFR <\/em>172 Subpart H<\/a>, the employer or supervisor must certify that the shipper&#8217;s training is appropriate for the types of shipments their employees offer into commerce.<\/p>\n\n\n\n<p>The shipper&#8217;s supervisor is accountable for any noncompliance issues that may result from inadequate training. Therefore, when identifying training options for the hazardous materials shipping coordinator the supervisor is encouraged to contact ORA for guidance.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Office of Research Assurances (ORA)<\/h3>\n\n\n\n<p>ORA arranges and coordinates the training requirements for the University. Contact ORA to request information regarding training options for both initial and refresher training.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Confirmation of training<\/h3>\n\n\n\n<p>After successful completion of hazardous materials training, the employee must provide ORA with a copy of the hazardous materials training certificate for inclusion in the shipping coordinators database.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Refresher training<\/h3>\n\n\n\n<p>The University requires refresher training every two years for all shipping coordinators. It is the responsibility of each department requiring a trained coordinator to monitor and ensure compliance with these requirements.<\/p>\n\n\n\n<div style=\"height:100px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading  wsu-heading--style-marked wsu-heading--mark-top\" id=\"import-export\">7. Import\/export<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Importing materials<\/h3>\n\n\n\n<p>Persons importing dangerous goods into the United States must provide the shipper and forwarding agent at the place of entry with information regarding the requirements of the Hazardous Materials Regulations (<a href=\"https:\/\/www.ecfr.gov\/cgi-bin\/text-idx?SID=028795e5b4a0b194cc473338c7237c13&amp;mc=true&amp;tpl=\/ecfrbrowse\/Title49\/49CIsubchapC.tpl\">49 <em>CFR <\/em>Subchapter C<\/a>) applicable to the shipment while in the United States.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Exporting materials<\/h3>\n\n\n\n<p>Prior to exporting any item, technology, or software from the United States, individuals must contact the <a href=\"https:\/\/research.wsu.edu\/assurances\/contact\/\">University Export Control Officer<\/a> to perform an export control review.<\/p>\n\n\n\n<div style=\"height:100px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading  wsu-heading--style-marked wsu-heading--mark-top\" id=\"noncompliance\">8. Noncompliance<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Intentional noncompliance<\/h3>\n\n\n\n<p>Intentional disregard or deliberate noncompliance with this University policy by any student, staff member, administrator, or faculty member may result in University corrective or disciplinary action.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Legal penalties<\/h3>\n\n\n\n<p>Failure to comply with <a href=\"https:\/\/www.ecfr.gov\/cgi-bin\/text-idx?SID=028795e5b4a0b194cc473338c7237c13&amp;mc=true&amp;tpl=\/ecfrbrowse\/Title49\/49CIsubchapC.tpl\">49 <em>CFR<\/em><\/a> may result in penalties for WSU and\/or an employee.<\/p>\n\n\n\n<p>WSU may be subject to civil penalties that can range from $275 to $75,000 per violation per day.<\/p>\n\n\n\n<p>Individuals can be subject to criminal penalties for knowing and willing violations. Such penalties can range up to $182,877 and if found guilty, an individual may face up to ten years in prison.<\/p>\n\n\n\n<div style=\"height:100px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading  wsu-heading--style-marked wsu-heading--mark-top\" id=\"defense-and-indemnification\">9. Defense and indemnification<\/h2>\n\n\n\n<p>Whenever a WSU officer, agent, or employee may, as a result of the good faith performance of his or her WSU duties, become subject to a lawsuit, claim, action, or proceeding, the law provides that the Board of Regents may authorize the defense of, and payment of all costs of, the proceeding. This includes the costs of any judgment that may arise out of the claim or proceeding.
